The provision on the objecting of the use of atomic energy to separate categories and the determination of the composition and boundaries of such objects

1. This provision establishes the procedure for attributing the objects of using atomic energy (hereinafter referred to as the object) to the categories specified in Article 3 of the Federal Law "On Atomic Energy Use", and determining the composition and boundaries of objects.

2. This provision does not apply to military facilities.

3. The organization operating in the field of use of atomic energy (hereinafter - the organization) is guided by the objective of the object to categories:

"Nuclear installations", "radiation sources", "fuel assembly of a nuclear reactor", "irradiated fuel assemblies of a nuclear reactor", "nuclear materials", "radioactive substances" - information contained in the passport to the object;

"Points of storage of nuclear materials and radioactive substances, storage points, radioactive waste repositories" - information contained in the design, design, technological and operational documentation;

Radioactive waste - criteria for assigning solid, liquid, gaseous waste to radioactive waste approved by the Government of the Russian Federation.

The assignment of the storage point of radioactive waste to the burial point of radioactive waste, the clause of long-term storage of radioactive waste, the placement of special radioactive waste and the clause of the conservation of special radioactive waste is carried out in accordance with the provisions of the Federal Law "On the handling of radioactive waste and on the amendments to the individual legislative acts of the Russian Federation. 4. When determining the composition of the object, the organization is guided:

With respect to the object attributed to the categories of "nuclear installations", "radiation sources", "fuel assembly of a nuclear reactor", "irradiated fuel assemblies of a nuclear reactor", "nuclear materials", "radioactive substances" or "radioactive waste", information, contained in the passport on the object;

With respect to the object, assigned to the category "Points of storage of nuclear materials and radioactive substances, storage points, radioactive waste repositories," information contained in the design, design, technological and operational documentation.

5. The boundaries of the object, assigned to the categories "Nuclear Installations", "Radiation Sources" or "Storage Points", are determined by the Organization on the basis of information contained in the decision on the construction and placement of the facility adopted in accordance with the provisions of the Federal Law "On the Use of Atomic Energy ".

6. The decision to classify the facility to the category of categories specified in paragraph 3 of this Regulation, and the definition of the composition and boundaries of the object is made by an authorized person of the organization.

What is OIAE - definition and detailed description These objects are in Art. 3 FZ-170 "On the use of atomic energy". According to the FZ, the objects of using atomic energy is:

  • nuclear installations;
  • radiation sources;
  • points of storage of nuclear materials and radioactive substances, storage points, radioactive waste repositories;
  • a fuel assembly of a nuclear reactor;
  • irradiated fuel assemblies of a nuclear reactor;
  • nuclear materials - materials containing or able to reproduce dividing (splitting) nuclear substances;
  • radioactive substances - non-nuclear substances emitting ionizing radiation;
  • radioactive waste;
  • nuclear fuel;
  • the spent nuclear fuel irradiated in the active zone of the reactor and finally removed from it.
In determining the installation, buildings, the unit as an object of using atomic energy should be guided by the "Regulations on the objecting of the use of atomic energy to individual categories and the determination of the composition and boundaries of such facilities," approved by the Government of the Russian Federation of December 30, 2012 No. 1494. Despite the fact that the Federal Law of 21.11.1995 N 170-FZ "On the Use of Atomic Energy" (hereinafter the law), among other things, is intended to promote the development of atomic science and technology, to promote the international mode of safe use of atomic energy, these goals are secondary compared with the above. Regulation of the economic development of the nuclear industry does not have significant differences from regulating other industries, which also confirms the root cause of the development of the law as a regulatory document aimed at reducing possible risks to the life and health of people, as well as risks of harm to the environment.

In the future, we will proceed from the fact that any activity in the field of atomic energy use to be licensed is not allowed without the availability of permission (license) to hold it precisely because of its potential danger.

Objects of use of atomic energy and licensed activities

The objects of applying the law (objects of use of atomic energy) are:

  • nuclear installations;
  • radiation sources;
  • points of storage of nuclear materials and radioactive substances, storage points, radioactive waste repositories;
  • a fuel assembly of a nuclear reactor;
  • irradiated fuel assemblies of a nuclear reactor;
  • nuclear materials;
  • radioactive substances;
  • radioactive waste.

At first glance, the above list of objects of using atomic energy seems illogical due to the inclusion of objects into it weakly comparable for any signs and inability to establish the classification criteria. According to the author, the legislator tried to guide the criterion of nuclear and radiation danger in the division of objects, but this logic was not fully implemented during the development of the law. From this point of view, in the list of objects of application of the law, I would like to trace a clear hierarchy in which the most dangerous element headed the list, and the least dangerous closed it.

Leaving outside this article, the question of perfection of the classification itself, it is worth noting that even the existing list of facilities are not as required in the course of developing sub-law legal acts and is not always correctly interpreted by licensing authorities. The terminology used in many regulatory regulatory and regulatory documents does not comply with the law that creates significant difficulties in binding the object to regulate the List of the Law.

The object on which or in respect of which activities are carried out, be sure to be included in the license in accordance with PP. e) P.27 provisions on licensing activities in the field of use of atomic energy. It is this provision for the most part that causes the difference in law enforcement practice and creates numerous problems in the course of procurement procedures, the subject of which is to be licensed.

In the framework of Rosatom's state corporation, the regulated procurement systems provides for the requirement of the participant of the procurement procedure necessary licenses at the time of submission of the application.

The introduction of the procurement system and the formation of the procurement practice of Rosatom state corporation revealed the problem of formulating the object of applying the law in licenses. Due to the lack of disputes, no one was revealed to the nuances of the special legal capacity of the enterprises of the nuclear industry. The openness of the procurement procedures and the need for the need to consolidate in the documentation of the license requirements showed the presence of completely different objects of applying the law in licenses of participants issued by various territorial Rostechnadzor authorities on the same actual type of activity.

The central office of Rostechnadzor of Russia and its territorial bodies in 2013 was issued more than 800 licenses to various organizations in the use of atomic energy. Considering that Rostekhnadzor is not the only licensing body in the areas under consideration and, taking into account the duplication of permits and supervisory functions, we can conclude that the volume of incorrect permissive documents Outgoing from the state is significant, and the problem of determining the object of application of the law will only be exacerbated with the expansion of the participation of licensees in the procurement procedures of enterprises of the State Corporation Rosatom.

Paragraph 4 of Article 26 of the law contains an exhaustive list of activities of the activities subject to licensing under this regulatory act. The wording of this provision is not ideal from the point of view of legal equipment. A large volume of text in the paragraph and a significant number of punctuation marks create various interpretation options. Nevertheless, all activities listed in this article relate to the objects specified in Article 3 and should be reflected in licenses. The question of the feasibility and admissibility of crushing and combining parts of this list, which occurs in law enforcement practice, remains open.

Given that the norms of Article 3 and Article 26 of the law are sufficiently harmonized with each other, the need to comply with the object of application under the law in the license may be questioned.

Codes in licenses

The Federal Service for Environmental, Technological and Nuclear Supervision, as part of the execution of its state function on licensing activities in the field of use of atomic energy, attempted to interpret Articles 3 and 26 of the Law.

Order of Rostechnadzor dated March 26, 2009 No. 195 (ed. Dated 05.05.2009) "On the introduction of the administrative regulations for the Federal Service for Environmental, Technological and Nuclear Supervision of the State Function on Licensing Activities in the field of use of atomic energy" contains tables of detailed lists of applications and licensed Activities in which each position corresponds to a specific code.

The above document launched the practice of specifying codes in the procurement documentation documentation and the subsequent rejection of participants with inconsistent codes without studying the actual content of the rights and obligations (special legal capacity) in the field of use of atomic energy. Rostekhnadzor authorities made their significant contribution to this confusion, allowing even the specification of codes on the text of the formulation of the type of activity in licenses.

For a certain period of time, most of the participants in legal relations, including the licensing authority, proceeded from the fact that the above order is mandatory for use. At the same time, the order of Rostechnadzor dated March 26, 2009 No. 195 was published in the publication "rationing in construction and housing and communal services", is not a regulatory document, and therefore did not pass as an examination and registration in the Ministry of Justice of the Russian Federation as a regulatory legal act. With a careful study of the title of Appendix No. 2 to this order - "The procedure for the formation of registration numbers of licenses for activities in the field of use of atomic energy", it becomes clear that we are talking about the internal office work and assignment of the license forms, and not the obligations to specify the codes in the license text .

The regulatory document, strictly defining the form and content of licenses, should be developed with the involvement of the expert community and the study of experience unsuccessful attempt regulation described above.

Conditions of license

It is necessary to note another serious problem of law enforcement practice associated with the incorrect interpretation of existing regulatory legal acts by Rostechnadzor.

Paragraph 3 of clause 3 of the Decree of the Government of the Russian Federation of 29.03.2013 N 280 (Ed. Dated December 24, 2013) "On licensing activities in the field of use of atomic energy" establishes that "license conditions - an integral part of the license containing the conditions necessary to ensure safety The object of using atomic energy and (or) type of activity on the specified object or with respect to the specified object that the licensee is obliged to implement (implement) and (or) to comply with the activities. Following the text and meaning of this norm, it is possible to make a clear conclusion that the license validity conditions should contain only the conditions necessary to ensure the safety of the object and (or) the type of activity.

In the practice of the author, there are a wide variety of cases of incorporating various additional illegal provisions in the conditions of licenses, from the indication of the activities other than the activities indicated in the license itself, before transferring the types of construction and installation work, which has the right to fulfill the licensee. This creates obstacles to the licensee's work on the competitive market and narrows its legal capacity. From an economic point of view, this leads to a decrease or limitation of competition in certain markets, and also prevents the reduction in customer's costs during procurement of certain works or services.

We consider it expedient to conduct an audit of the current licenses, taking into account the correct interpretation of the possible content of the license conditions (the elimination of all the safety of provisions), or an expert discussion of the expediency of expanding the possible content of such conditions.

Provision of services to operating organizations

The law provides that permits (licenses) for the right to work in the field of use of atomic energy are issued to operating organizations, as well as organizations performing work and providing services in the field of use of atomic energy. The legislator conducts a clear separation of types of licensed organizations, which is completely acquitted from the point of view of nuclear and radiation safety. The law also provides that the operating organization carries the entire fullness of responsibility for the safety of the object of applying the current license.

In practice, we are faced with the next incorrect interpretation of the principles and provisions of the law. Significantly the number of licenses contains the formulation of the following type - "Operation of the nuclear installation in terms of the provision of services of the operating organization." In such a case, not only the mixing of different types of licensed organizations, but also a violation of the principle of completeness of the responsibility of the operating organization.

Such formulations together with the manifold of unlawful conditions of license validity makes it almost impossible to clearly define the object of application and the type of activity in the organization's license, which is planned to be attracted to carry out work or the provision of services in the use of atomic energy.

In order to localize responsibility, it is necessary to terminate the practice of issuing licenses for the operation of the objects of the application of the law to anyone, except for organizations really exploiting them. Organizations operating and providing services to operating organizations, licenses should be issued taking into account the correct classification of the object of application based on the real subject of such works or services.

The analysis does not claim to be a complete study of the problems of regulating the nuclear industry and demonstrates only those aspects with which it is necessary to encounter when conducting procurement activities. Construction of objects containing or using nuclear materials and radioactive substances is carried out in accordance with project documentation, including, in some cases, the construction of auxiliary real estate facilities, such as access roads, construction bases, facilities for accommodation staff, table buildings, gyms , warehouses, medical deposits, training centers, etc. The inclusion of auxiliary objects of capital construction into a single project documentation with objects containing or using nuclear materials and radioactive substances is not a criterion for assigning work on the construction, reconstruction and overhaul of these capital construction facilities, to work that affect the safety of the objects of use of atomic Energy. Given the above, Appendix No. 1, 2, 3 of Resolutions No. 207 does not apply to the work performed on the facilities and their engineering networks technologically not related to the functioning of the use of atomic energy.
