DECISION of the Government of the Russian Federation of July 21, 2008 N 549 "ON THE PROCEDURE OF GAS SUPPLY TO PROVIDE COMMUNAL AND DOMESTIC NEEDS OF CITIZENS"

In accordance with the Federal Law "On Gas Supply in Russian Federation"The Government of the Russian Federation decides:

1. To approve the attached Rules for the supply of gas to meet the household needs of citizens.

2. Establish that:

methodological support of activities to monitor the maintenance and condition of indoor gas equipment is carried out by the Federal Service for Environmental, Technological and Nuclear Supervision;

gas supply contracts entered into prior to the entry into force of the Rules approved by this Resolution shall remain in force until their expiration or until their renewal.

3. In clause 13 of Section V of Appendix No. 1 to the Rules for the Provision of Utilities to Citizens, approved by Decree of the Government of the Russian Federation No. 307 of May 23, 2006 "On the Procedure for Provision of Utility Services to Citizens" (Collected Legislation of the Russian Federation, 2006, No. 23, Art. 2501), the words "13. Supply gas pressure from 0.003 MPa to 0.005 MPa" shall be replaced by the words "13. Supply gas pressure from 0.0012 MPa to 0.003 MPa".

The Ministry of Regional Development of the Russian Federation in connection with numerous requests from the executive authorities of the constituent entities of the Russian Federation, local authorities, consumers and suppliers of gas, in order to form a uniform practice of applying the Rules for the supply of gas to meet the household needs of citizens, approved by the Decree of the Government of the Russian Federation of 21 July 2008 N 549 (hereinafter referred to as the Rules for the Supply of Gas to Ensure the Domestic Needs of Citizens), sends clarifications on the structure of the normative regulation of relations on the supply of gas to ensure the domestic needs of citizens after entry into force.

WHICH ARE SUBMITTED TO THE REGULATION OF THE GOVERNMENT OF THE RUSSIAN

1. In the name and text of the word ", within the framework of the subprogram" Timber industry complex "of the state program of the Russian Federation" Development of industry and increasing its competitiveness "shall be excluded.

2. In the Rules for the provision of subsidies from the federal budget to organizations of the timber industry complex to reimburse part of the costs of servicing loans received from Russian credit institutions in 2011-2015 for the purpose of forming seasonal stocks of raw materials, materials and fuel, within the framework of the “Timber industry complex” subprogram of the state program Of the Russian Federation "Development of industry and increasing its competitiveness", approved by the specified resolution:

"2. The subsidy is provided to reimburse part of the costs of servicing loans received in order to implement the following costs for the formation of seasonal stocks of raw materials, materials and fuel:

a) for logging organizations of the timber industry complex:

for the purchase of spare parts, components, products and assemblies for logging equipment;

for fuels and lubricants;

b) for timber processing organizations of the timber industry complex:

for the purchase of unprocessed timber;

for transport services (except for export supplies) for the transportation of unprocessed timber;

for fuels and lubricants. ";

c) in paragraph 3:

the first paragraph shall be stated in the following edition:

"3. The subsidy is provided on the basis of an agreement between the Ministry of Industry and Trade of the Russian Federation and the organization of the timber industry complex for the provision of a subsidy, concluded for a period of not more than 3 years, in accordance with the standard form established by the Ministry of Finance of the Russian Federation (hereinafter - the agreement on the provision of subsidies) . The agreement on the provision of subsidies provides, among other things: ";

subparagraph "c" shall be stated as follows:

"c) the obligation of the Ministry of Industry and Trade of the Russian Federation and the state financial control bodies to conduct inspections of the organization's compliance with the conditions, purposes and procedure for granting subsidies established by the agreement and these Rules, and the consent of the organization of the timber industry complex to conduct such inspections;";

subparagraph "d" shall be declared invalidated;

d) in paragraph 4:

the subparagraph "c" after the words "chief accountant" shall be supplemented with the words "(if any)";

supplement with subparagraphs "d" - "h" of the following content:

"d) a certificate of the tax authority on the 1st day of the month preceding the month in which it is planned to conclude an agreement on the provision of a subsidy, confirming that the organization of the timber industry complex has no unfulfilled obligation to pay taxes, fees, insurance premiums, penalties, fines, interest payable in accordance with the legislation of the Russian Federation on taxes and fees (if the organization of the timber industry complex does not submit such a document, the Ministry of Industry and Trade of the Russian Federation requests it independently);

e) a certificate signed by the head and the chief accountant (if any) of the organization of the timber industry complex, sealed by the seal of this organization (if any) on the 1st day of the month preceding the month in which it is planned to conclude an agreement on the provision of a subsidy, confirming that the organization does not have a timber industry complex overdue debts on the return of subsidies to the federal budget, budgetary investments provided, inter alia, in accordance with other legal acts, and other overdue debts to the federal budget;

f) a certificate signed by the head and the chief accountant (if any) of the organization of the timber industry complex, sealed with the seal of this organization (if any) on the 1st day of the month preceding the month in which it is planned to conclude an agreement on the provision of a subsidy, confirming that the organization of the timber industry complex is not in the process of reorganization, liquidation, bankruptcy;

g) a certificate signed by the head and chief accountant (if any) of the organization of the timber industry complex, sealed by the seal of this organization (if any) on the 1st day of the month preceding the month in which it is planned to conclude an agreement on the provision of a subsidy, confirming that the recipient of the subsidy is not is a foreign legal entity, as well as a Russian legal entity, in the authorized (pooled) capital of which there is a share of participation of foreign legal entities whose place of registration is a state or territory included in the list of states and territories approved by the Ministry of Finance of the Russian Federation that provide a preferential tax regime of taxation and (or) not providing for the disclosure or provision of information when conducting financial transactions (offshore zones) in relation to such legal entities, in aggregate exceeds 50 percent;

h) a certificate signed by the head and chief accountant (if any) of the organization of the timber industry complex, sealed with the seal of this organization (if any), confirming that this organization does not receive funds from the federal budget to reimburse part of the cost of paying interest on subsidized in accordance with these By the rules of credit agreements. e) clauses 6 and 7 shall be stated as follows:

"6. The Ministry of Industry and Trade of the Russian Federation, within 15 working days, considers an application for concluding an agreement on the provision of a subsidy and concludes an agreement on the provision of a subsidy with the organization of the timber industry complex or refuses (in writing) to conclude an agreement on the provision of a subsidy in the following cases:

a) non-compliance of the submitted documents with the provisions of paragraphs 1, 2 and 4 of these Rules;

b) failure to submit (submission not in full) of these documents;

c) submission of false information.

7. The subsidy is provided on a quarterly basis.

Subsidies to reimburse part of the cost of servicing loans received in the currency of the Russian Federation are provided in the amount of two-thirds of the key rate of the Central Bank of the Russian Federation in effect at the date of payment of interest on the loan. If the interest rate on the loan is less than the key rate of the Central Bank of the Russian Federation, in effect at the date of payment of interest on the loan, part of the costs are reimbursed at the rate of two-thirds of the costs incurred by the forestry organization to pay interest on the loan.

Subsidies for reimbursement of part of the cost of servicing loans received in foreign currency are provided in rubles at the rate of two-thirds of the amount of costs incurred by the forestry complex to pay interest on a loan based on the official exchange rate of foreign currency in relation to the ruble established by the Central Bank of the Russian Federation as of the date payment of interest on the loan. When calculating the amount of the subsidy, the marginal interest rate on a loan received in foreign currency is set at two-thirds of the key rate of the Central Bank of the Russian Federation. ";

f) in clause 8 the words "budgets of the budgetary system of the Russian Federation" shall be replaced by the words "federal budget";

g) in clause 10 the words "provided in the established manner to the Ministry of Industry and Trade of the Russian Federation" shall be replaced by the words "brought in the established manner to the Ministry of Industry and Trade of the Russian Federation as a recipient of federal budget funds";

h) in clause 11:

subparagraph "a" shall be stated in the following edition:

"a) a certificate of the tax authority as of the date not earlier than the 1st day of the month preceding the month in which documents are submitted for obtaining a subsidy, confirming that the organization of the timber industry complex has no unfulfilled obligation to pay taxes, fees, insurance premiums, penalties, fines, interest, payable in accordance with the legislation of the Russian Federation on taxes and fees (if the organization of the timber industry complex does not submit such a certificate, the Ministry of Industry and Trade of the Russian Federation requests it independently); ";

subparagraph "b" shall be stated as follows:

"b) a certificate signed by the head and the chief accountant (if any) of the organization of the timber industry complex, sealed with the seal of this organization (if any), confirming that this organization does not receive funds from the federal budget to reimburse part of the cost of paying interest on subsidized loan agreements with these Rules; ";

supplement with subparagraphs "z" and "and" of the following content:

"h) a certificate signed by the head and chief accountant (if any) of the organization of the timber industry complex, sealed with the seal of this organization (if any), indicating the bank details of the settlement account of the organization of the timber industry complex, to which, if a positive decision is made, the subsidy will be transferred;

i) a certificate signed by the head and chief accountant (if any) of the organization of the timber industry complex, sealed with the seal of this organization (if any), confirming that this organization is not a foreign legal entity, as well as a Russian legal entity, in the authorized (joint) capital of which the share of participation of foreign legal entities whose place of registration is a state or territory included in the list of states and territories approved by the Ministry of Finance of the Russian Federation that provide a preferential tax regime for taxation and (or) do not provide for the disclosure or provision of information when conducting financial transactions (offshore zones) in in relation to such legal entities, in aggregate, exceeds 50 percent. ";

i) paragraph one of clause 13 after the words "In case of improper execution" add words ", submission of documents not in full, submission of inaccurate information, the presence of overdue debt on monetary obligations to the Russian Federation, as defined in article 93.4 of the Budget Code of the Russian Federation,";

j) clause 15 after the words "chief accountant" shall be supplemented with the words "(if any)", after the words "and sealed with the seal of this organization" shall be supplemented with the words "(if any)";

k) clause 19 shall be supplemented with the words ", not later than the 10th working day after the decision by the Ministry of Industry and Trade of the Russian Federation to provide a subsidy";

l) Clause 20 shall be stated in the following edition:

"20. In case of establishing the facts of violation of the purpose, conditions and procedure for the provision of subsidies, the corresponding cash are subject to return to the federal budget in the manner prescribed by the budgetary legislation of the Russian Federation, within 30 working days from the date of receipt of the corresponding request from the Ministry of Industry and Trade of the Russian Federation or the authorized body of state financial control

If it is established that the organization of the timber industry complex does not achieve the efficiency indicators for the provision of subsidies provided for in paragraph 14 of these Rules, penalties are applied to it, the amount of which is calculated in accordance with paragraph 16 of these Rules and is subject to transfer by the organization of the timber industry complex to the federal budget in the manner established by the budget the legislation of the Russian Federation, within 30 working days from the date of receipt of the relevant request from the Ministry of Industry and Trade of the Russian Federation or the authorized body of state financial control.
